Terms and Conditions

The following conditions of use will apply to and bind everyone (you or the customer) using the Moto Trainer Simulator under any service offered.
Exclusion of liability and waiver

 

• MotoTrainer Perth (62 865 744 595) in the person of Stefano Cavalli as supplier of recreational and coaching services (including private hiring), sells all the services to you including, but not limited to recreational experience, coaching courses, private/corporate hire.

• By booking any of our services, the customer represents to be 18 years old or older and has given us any consent to allow any of their minor dependents the use of our services.

​

• The customer acknowledges that the recreational activities are potentially dangerous and hazards and as consequence personal injury can occur and the customer assumes and accepts all such risks and hereby waives the right to sue MotoTrainer Perth for any damage to property, personal injury or death in any way whatsoever, whether caused by the negligence of MtoTrainer Perth or its agents or employees or otherwise, caused by or relating to the customer’s participation  in the recreational activities. The customer agrees and undertake any such risk voluntarily, and the assumption of risk and warning above constitutes a “risk warning” in accordance with relevant legislation, including the Civil Liability Act 2002 (WA).

• The recommended maximum weight limit for customers is 120Kg, the total combined weight (rider and motorcycle) allowed on the machine is 330Kg. The customer agrees in providing their approximate weight in order to comply with those limits, and to allow Moto Trainer Perth to set the machine accordingly and offer the best experience.

• Subject to the proper adherence with the requirements of the Privacy Act 1988 (Cth), while on the simulator on in its close proximity, customer consents to images and videos to be taken for security and promotional purposes of themselves, their children or of children for whom customers responsible.

• MotoTrainer Perth is not held in any way responsible for any articles and customer’s personal belongings that may be lost, broken, or stolen while taking part of any service provided by MotoTrainer Perth.

• Customer’s payment provided as result of booking for any type of service provided by MotoTrainer Perth cannot be refunded, transferred, or resold unless otherwise expressively granted by MotoTrainer Perth.

• Customers must be in good health and free from any adverse medical condition. For safety reasons, pregnant women, customer with pre-existing helath issues or wearing casts are not permitted on the simulator. If unsure please seek medical advise before using the equipment.

• Customer agrees to pay for any damage to the equipment caused by himself or any minors for whom the customer is responsible.

​

• This agreement is governed by the laws of Western Australia, the Courts of which shall have exclusive jurisdiction, and if any part or provision is determined by a Court to be invalidor unenforceable all other parts and provisions shall still be given full legal effect.

• All Intellectual Property in any material on the website is the property of Moto Trainer perth, its advertisers or third party providers. Unless expressly authorised under this agreement, you may not reproduce, adapt, modify, display, perform or distribute any material or any part of any material, all trademarks, forms of advertising or publicity that relates to distribution of this information appearing on this website. “Moto Trainer perth” or any of the above trademarks or logos shall not be used in any way without specific, written prior permission from the appropriate parties.

• We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.

• We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.
